In order to be eligible to win one of the prizes or participate in the Drawing, you must complete the survey during the Term.

1. ELIGIBILITY

To be eligible to enter The Bayou Survey Drawing (hereinafter, “Drawing”), you must have (i) agreed to take and complete the Survey (“Survey”) and be (ii) above the age of 21 at the time of entry. Employees, officers, and directors of The Bayou, its agents or affiliates, advertising or promotional agencies, and their immediate families and those living in their households, are not eligible to participate in the Drawing. Void where prohibited. All federal, state, and local laws and regulations apply.

2. TERM

The Survey begins at 12:01 a.m. mountain standard time (MST) on May 26th, 2009, and ends when cancelled by The Bayou (“Term”).  Drawings are held every other week during the Term.

3. SPONSOR

The Sponsor is Beervana, Inc. DBA The Bayou.  645 S. State Street, SLC, UT 84111

4. TO ENTER

No purchase IS NECESSARY TO ENTER OR to WIN. During the Term, potential entrants may visit The Bayou to receive a receipt with no items charged to in for entry purposes. To enter the Drawing, click on the survey link at www.utahbayou.com, complete the survey questions, and provide your email address.

Note: You must complete the survey during the Term to be eligible to receive the prizes described below.

LIMIT: ONE (1) ENTRY PER PERSON AND EMAIL ADDRESS PER BAYOU TRANSACTION NUMBER. LIMITED TO 1 ENTRY PER DRAWING CYCLE. Subsequent entries will be disqualified. All entries become the property of Sponsor. They will not be returned or acknowledged. Sponsor is not responsible for lost, late, misdirected, mutilated, incomplete, or illegible entries, or for any computer-related, online, telephonic, or technical malfunctions that may occur. Entries are void if they are in whole or in part illegible, incomplete, damaged, irregular, altered, counterfeit, produced in error, forged, mechanically reproduced, or obtained through fraud or theft. By entering, you agree to be bound by these Official Rules. If you are entering on behalf of your employer, these rules are binding on you, individually, and your company.

In the event of a dispute regarding who submitted an entry, the entry will be deemed submitted by the authorized account holder of the email address submitted at the time of entry. “Authorized account holder” is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider, or other organization that is responsible for assigning email addresses for the domain associated with the submitted email address. A selected entrant may be required to provide Sponsor with proof that he/she is the authorized account holder of the email address associated with the selected entry.

5. WINNERS

All decisions on all matters pertaining to the Drawing are final.  Limit one prize per person, family, or household per drawing. Odds of winning depend on the number of eligible entries received.

Prizes: One (1) Prize winners will be selected by a random drawing every other week to receive a Bayou gift card in the amount of US$50. ARV: $50.00.

Total ARV: US$50.00/drawing.

Gift card may not be exchanged for cash and no change will be given on any transaction. Gift card will remain valid until its full value is used. Gift card may not be used to pay for tips and may not be used to pay for any items in violation of Utah law.

6. WINNER NOTIFICATION

Random selection of the potential winners will occur semi-weekly starting on or about June 2, 2009, from among all eligible entries received during the two week period prior to drawing. Prize drawing will be conducted at Sponsor’s office in Salt Lake City, UT. The potential winners will be notified by email within 1 week of drawing. Potential winners will have fourteen (14) days from notification to claim their prize. Sponsor and its affiliates, subsidiaries, employees, agents, officers and directors, advertising and Drawing agencies, and their respective officers, directors, employees, and their respective agents will not be liable for unsuccessful efforts to notify a winner. The prize will be available for pickup at The Bayou. No prize transfer, assignment, or substitution by winner permitted. All federal, state, and local taxes, fees, and surcharges on prizes are the sole responsibility of the winners. If any potential winner declines the prize, fails to claim the prize, is unavailable for prize fulfillment, fails to abide by the Official Rules, or is ineligible, Sponsor may select an alternate winner from all remaining eligible entries. If any prize or prize notification is returned as undeliverable, that prize is forfeited and Sponsor may select an alternate winner from all remaining eligible entries.

7. LIMITATION OF LIABILITY

Sponsor reserves the right at its sole discretion to cancel, terminate, modify, or suspend the Drawing.

By participating, entrants and winners release Sponsor, its affiliates, parent, and subsidiary companies; its employees, agents, and officers; and its advertising and promotion agencies, as well as all others associated with the development and execution of this Drawing, from and against any and all liability with respect to or in any way arising from the Drawing and the awarding and use of the prizes. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, or delay in operation or transmission; communications line failure; theft or destruction of or unauthorized access to Drawing entries or entry forms; or alteration of entries or entry forms.

Participants also agree (a) to be bound by these Official Rules; and (b) that the decisions of Sponsor are final on all matters relating to the Drawing. Winner agrees to be bound by these rules and the decisions of Sponsor, whose decisions are final and binding.

If you are acting within the scope of your employment, as an employee, contractor, or agent of another party, you warrant that such party has full knowledge of your actions and has consent thereto. You further warrant that your actions do not violate your employer’s or company’s policies and procedures.

8. LAWS

This Drawing is governed by the laws of the State of Utah, USA, without regard to the conflicts of law provisions.

9. WINNERS LIST

To obtain the names of the winners, send a request, along with a self-addressed, stamped envelope, to Legal Department, Beervana, Inc., 645 S. State Street., Salt Lake City, UT 84111 USA. You will be required to sign a confidentiality agreement prior to receiving the winners list.
